Why was I charged with DUI Refusal?
Personally have heard this question numerous times. Why was I charged with DUI Refusal and took the test? Do you remember if the breathalyzer registered a reading? or Were you asked to blow several times? If so, did you ask why? On occasion there are problems with the machine and it maybe easier to charge DUI refusal.
Now just because you blew, doesn’t mean there was complete co-operation. Other factors to consider: Do you remember any smack talk to the officer? or Sickness left in the officers car? or Passing out while taking the test?
